Luigi Mangione, the 27-year-old accused of assassinating UnitedHealthcare CEO Brian Thompson in Manhattan on December 4, 2024, is scheduled to appear in Manhattan Supreme Court on Tuesday, as reported by The New York Post.

The hearing is expected to address whether prosecutors can present Mangione’s personal diary to jurors during his upcoming trial.

Mangione, a University of Pennsylvania graduate from a prominent Baltimore family, faces charges of murder as an act of terrorism, which carries a maximum sentence of life in prison without parole. He has pleaded not guilty.

The red diary, along with a partially 3D-printed pistol, zip ties, and duct tape, was recovered by police in Altoona, Pennsylvania, after Mangione was captured following a five-day manhunt.

Prosecutors say the notebook contained detailed writings in which Mangione allegedly plotted Thompson’s murder and expressed his intent to make a public statement against the healthcare industry.

In an entry dated October 22, Mangione allegedly wrote: “The point is made in the news headline Insurance CEO killed at annual investors conference. It conveys a greedy bastard that had it coming.”

Prosecutors argue the writings are central to proving their claim that Mangione carried out a premeditated “act of terrorism” by executing Thompson, a father of two, in broad daylight during UnitedHealthcare’s annual investor conference.

Defense attorneys, however, are pushing to suppress the diary and other materials found in Mangione’s possession. They argue that Altoona police violated his constitutional rights by searching his belongings before obtaining a warrant.

The Manhattan District Attorney’s Office disputes that claim, insisting the evidence was lawfully obtained and should be presented to jurors.

Judge Gregory Carro, who is presiding over the case, may also set a trial date during Tuesday’s hearing. Manhattan District Attorney Alvin Bragg’s office is prosecuting the state charges, while Mangione is also facing a separate federal murder case that could carry the death penalty.

His attorneys have asked the court to pause the New York proceedings until the federal trial is complete.

Another issue that could arise is whether Mangione intends to use a psychological defense. Earlier this month, prosecutors accused the defense of missing a deadline to declare such a strategy.

Mangione’s attorneys countered that revealing their plans would compromise their approach in the federal case.

Mangione, who has previously praised domestic terrorist Ted Kaczynski, continues to draw attention from followers who have camped outside the courthouse ahead of his appearance. The hearing is scheduled for 9:30 a.m. Tuesday at 100 Centre Street in Manhattan.
