Fox News host Mark Levin said Wednesday that the judge who tried to prevent the Trump administration from deporting 261 members of Tren de Aragua (TdA) to El Salvador forgot some key points of “Judging 101.”
President Donald Trump invoked the Alien Enemies Act of 1798 to speed up the deportation of TdA gang members Saturday, but U.S. District Judge James Boasberg of the District of Columbia issued an injunction ordering the Trump administration to turn around two planes carrying members of the gang to El Salvador. Levin said Boasberg made several mistakes during the hearing, when host Martha MacCallum brought up the case of Landmark Legal Foundation vs. EPA, which Levin was involved in. “Let me try to help this renowned radical left-wing judge. This is called Judging 101. If you want someone to do something, they need to understand what you want them to do,” Levin said. “Martha, there are a lot of people in between that courtroom and the flight. The president of the United States isn’t in the courtroom. The attorney general is not in the courtroom. The secretary of DHS isn’t in the courtroom. Literally hundreds and hundreds of people are affected by this judge’s orders.”

“He knows this. He’s a judge in the District of Columbia where the bureaucracy thrives. When you are a judge, Judge 101, you don’t just sit at the bench and say you know, you have to stop doing this and stop doing that. It doesn’t necessarily get to everybody, certainly not in a timely way,” Levin added. “He figured it out. It was a little late. It’s only been the custom practice and tradition in that courtroom for at least 23 years, when I litigated this case, which is, put your damn order in writing, judge, so the people you are bullying around, or ordering around, know exactly what you’re doing. It’s called giving them notice. That’s what it’s called.”
Trump issued several executive orders to address illegal immigration, including one that designated Mexican drug cartels, TdA and MS-13 as foreign terrorist organizations. TdA is a violent gang whose members have allegedly been involved in the takeover of apartment complexes in Aurora, Colo., as well as kidnapping and murder.
Levin warned that the injunctions were a potential constitutional crisis and threatened to usurp powers that belonged to the president.
“This whole thing is becoming a sham. The American people are losing faith in the judiciary. We can’t have a judicial oligarchy of unelected judges at the trial court level who aren’t even in the Constitution telling the president what to do on human resources, on the border, on deporting criminal illegal aliens,” Levin said. “I mean, wait until we get to noncriminal illegal aliens. Can’t tell him he can’t look at payroll or data. What is it that the president can do? Martha, these are ministerial tasks, these are normal tasks for the president of the United States.”
