SiriusXM host Megyn Kelly accused Democrats on Thursday of using the court system to obstruct President Donald Trump’s administration, saying legal challenges are creating a “whack-a-mole” scenario that distracts from enacting policies supported by voters.
During an episode of The Megyn Kelly Show, Kelly criticized what she described as a legal onslaught against the administration, pointing to the 49 lawsuits filed against Trump’s executive actions since he took office on January 20.
According to Fox News Digital, Trump has already signed approximately 60 executive orders, many of which have faced immediate legal pushback.

Kelly expressed frustration over what she called Democrat-led “lawfare”, arguing that Trump is ultimately prevailing in these legal battles but is being forced to dedicate substantial resources to fighting them.
“I’m irritated at the lawfare that is being unleashed against Trump’s agenda at every turn. Now it’s like this administration is having to play whack-a-mole in the courts instead of just enacting the people’s will. Every day it’s another lawsuit to try to stop what Trump clearly has the power to do,” Kelly said.
She went on to highlight Trump’s success in fighting back against legal challenges, stating:
“What I see after the whole morning researching this bullshit … is that Trump’s winning. He’s winning these cases, right? But think of the distraction by his lawyers, by his federal agencies, everything Elon’s doing. They’re trying to stop bit by bit.”
In a significant win for the administration, U.S. District Judge George O’Toole Jr. ruled against a lawsuit attempting to block Trump’s plan to offer federal employees a payout.
The judge determined that the labor union behind the lawsuit lacked legal standing, effectively dissolving the temporary hold on the payments.
Reports estimate that more than 70,000 federal employees have already taken the payout, prompting Kelly to question the process behind these disbursements.
“What is the Treasury paying out? To whom? All Trump’s cabinet heads, like Treasury? EPA?” Kelly asked.
“What grants have we given in the waning days of the Biden administration and to whom, against the taxpayer’s wish? It’s just boondoggle. They’ve just been throwing money off of a sinking ship, the Biden administration.”
Kelly argued that Trump, alongside Elon Musk and the Department of Government Efficiency (DOGE), is working to halt improper spending but is facing lawsuits intended to force compliance with decisions made under the previous administration.
“Trump and Elon are like, ‘Whoa, whoa, whoa, let’s hold on. Let’s just see. We don’t approve this, and we can stop it.’ The Democrats sue them saying ‘You have to allot the funds because Biden said so or Congress said so,’” Kelly said.
Democratic lawmakers have intensified their opposition to both Trump’s downsizing of the federal government and Elon Musk’s role in the administration.
The Department of Government Efficiency, led by Musk, has spearheaded efforts to streamline federal agencies, including a plan announced on February 3 to dismantle the U.S. Agency for International Development (USAID).
The move has drawn sharp criticism from Democratic officials, including Rep. Maxine Dexter (D-OR), who joined American Federation of Government Employees (AFGE) union members in protesting the changes outside the White House.
During the demonstration, Dexter was heard chanting expletives about Trump, urging supporters to “f**k Trump.”

As legal challenges continue to mount against Trump’s executive actions, Kelly maintains that the administration is prevailing in court.
However, she warns that the endless lawsuits are a deliberate effort to hinder the president’s ability to implement his policies and fulfill campaign promises.
