The Department of Homeland Security (DHS) sharply criticized The New York Times on Saturday for omitting a key fact in its reporting on a recent criminal case in New York City involving a suspect accused of raping a corpse on the subway.

Per the NYPD, Felix Rojas found a dead or dying father on the New York Subway. Rather than administer first aid or call for help, Rojas allegedly robbed him, then returned to spend thirty minutes raping his corpse.

According to DHS officials, the Times failed to disclose that the suspect, identified as an illegal alien, had repeatedly entered the country unlawfully over the past several decades.

Tricia McLaughlin, the DHS Assistant Secretary for Public Affairs, posted a public statement on X calling out the newspaper’s reporting.

“The New York Times refused to mention anywhere in its 400-word story on the monstrous rape of a corpse on the NYC subway that the depraved perpetrator is an ILLEGAL alien,” McLaughlin wrote. “Why not report the facts, @nytimes?”

Fox News Digital reported that attempts were made to reach out to The New York Times for comment regarding the omission. As of now, the outlet has not responded publicly.

The story in question revolves around 44-year-old Felix Rojas, who authorities say was arrested by the NYPD after being caught allegedly committing acts of rape and theft on a deceased individual aboard a Manhattan subway train.

According to law enforcement sources cited by Fox News, a man who had died from natural causes was found slumped in a seat on the R train.

Rojas allegedly searched the man’s pockets and then proceeded to engage in sexual activity with the body after scanning the train for witnesses.

DHS confirmed that Rojas is in the country illegally and has crossed into the U.S. multiple times since 1998.

A press release from the department announced that U.S. Immigration and Customs Enforcement (ICE) issued a detainer on Rojas on May 1, three days after The New York Times published its original article, which remains uncorrected or updated to reflect the suspect’s immigration status.

Several other media outlets also omitted information about Rojas’ immigration status when the story initially broke.

The New York Post, for example, reported on the incident without mentioning the suspect’s background but later issued a follow-up story confirming his illegal presence in the United States.

Investigators have not ruled out the possibility that Rojas may be linked to other criminal activity throughout New York City.

Authorities continue to probe for potential connections.

In a broader statement about the implications of this case, McLaughlin pointed to what she described as the consequences of lax immigration enforcement.

“With impunity, open-border policies have allowed violent criminal aliens to terrorize America’s towns and cities,” she said.

“Under President Trump and Secretary [Kristi] Noem’s leadership, ICE is working around the clock to remove the worst of the worst from our communities,” McLaughlin continued.

“If you are here illegally and break the law, we will hunt you down, arrest you and lock you up.”
