The city of Malibu has filed a lawsuit against Los Angeles and the state of California over the destructive Palisades fire, alleging that officials failed to take adequate steps to prevent the blaze that tore through the coastal community, as reported by The New York Post.

In a 66-page complaint, Malibu argues that the wildfire dramatically altered the city and left lasting damage. According to the suit, the fire “hollowed out” the oceanside community and changed its character.

Malibu said the city’s “entire character changed” when the wildfire swept through and that it is “still reeling from the destruction it left in its wake,” according to the complaint.

The lawsuit seeks to “recover significant financial losses” tied to the fire’s impact.

Malibu Mayor Bruce Silverstein addressed the filing in a public statement.

“This decision was not made lightly,” Silverstein said.

“The City has an obligation to act in the best interests of our residents and taxpayers. The lawsuit seeks accountability for the extraordinary losses suffered by our community while recognizing that Malibu must continue to work collaboratively with our regional partners going forward.”

The complaint outlines damage across multiple areas of Malibu, including the Carbon Beach neighborhood.

It references burn scars near the Pacific Coast Highway and businesses that were destroyed. According to the lawsuit, the fire “destroyed over 700 homes and dozens of businesses” within city limits.

City officials contend that the fire was not simply a natural disaster. The suit alleges that the damage was tied to what it describes as the “unlawful conduct” of the defendants.

In particular, the complaint states that Los Angeles and the state prioritized “rare plants over human lives in failing to inspect and address the dangerous burn scar from the Lachman Fire that ignited just days before on its own land – its smoldering embers remaining clearly visible to anyone who cared to look.”

The lawsuit further claims that state employees interfered with firefighting efforts by objecting to the removal of dry vegetation surrounding the earlier Lachman Fire burn area.

According to the complaint, those employees argued that certain plants required protection, which the city says hindered efforts to reduce fire risk.

Malibu officials also cited broader infrastructure and economic damage.

In its statement, the city said it “experienced damage to roads, stormwater systems, public buildings, and open-space lands, as well as significant disruption to tourism, employment, and local revenue.”

The filing seeks to recover “costs associated with emergency response, infrastructure repair, environmental restoration, and lost revenues.”

The case places renewed attention on wildfire management practices in Southern California, including land maintenance, environmental protections, and coordination between state and local agencies.

Malibu’s legal action signals a push by the city to hold regional and state authorities financially responsible for the aftermath of the Palisades fire as recovery efforts continue.
