Rep. Elise Stefanik (R-NY) is calling for a federal investigation into the Saratoga Springs City School District following its adoption of a resolution allowing transgender students to participate in girls’ sports and use gender-aligned facilities—policies the congresswoman says are in “direct violation” of President Donald Trump’s executive order on women’s sports, as reported by The New York post.

In a letter sent Monday to U.S. Education Secretary Linda McMahon, Stefanik urged the Department of Education to launch a formal inquiry into the district’s “Affirming Our Support for Every Student” resolution, which was approved on March 27 by the Saratoga Springs City Board of Education.

The resolution states that transgender students have the right to “use facilities and partake in activities and sports consistent with their gender identity.”

Stefanik, whose district includes Saratoga Springs, said the district’s action defies Executive Order 4201, signed by President Trump, titled “Keeping Men Out of Women’s Sports.”

She also cited potential violations of Title IX, the federal statute that prohibits sex-based discrimination in schools receiving federal funding. In her letter, a copy of which was obtained by The New York Post, Stefanik wrote:

“Allowing biological males into girls’ sports and locker rooms is in direct violation of Title IX and President Trump’s executive order. Our daughters should not be forced to compete against biological men in competitive sports or share a locker room with biological men.”

Stefanik warned that the district’s actions could put at risk some of the approximately $3 million in federal funding it receives annually if the Department of Education determines it is not in compliance with federal law.

She called on the Department’s Office of Civil Rights to open an investigation into what she described as a “blatant violation” of federal law and the president’s order.

“I join President Trump in his commitment to protect our nation’s girls and daughters. This Far Left woke ideology has no place in our communities.”

In addition to her stance on school sports policies, Stefanik continues to take aim at elite academic institutions for alleged failures to confront antisemitism.

Last week, she co-signed a letter to Harvard President Alan Garber demanding records related to hiring practices, DEI programs, and admissions protocols.

She and House Oversight Chair James Comer (R-KY) raised concerns about international applicants who may harbor anti-American or antisemitic views.

The Trump administration has taken further steps, including freezing $2.2 billion in federal grants and $60 million in contracts to Harvard University. President Trump has also suggested reconsidering the school’s tax-exempt status.

Stefanik, a Harvard alumna herself, previously grilled university leaders in a December 2023 House Education and Workforce Committee hearing. Then-Harvard President Claudine Gay resigned weeks later amid plagiarism allegations.

Stefanik is reportedly weighing a gubernatorial bid.
