A recent report from NBC News revealed shock and panic within the Department of Justice (DOJ) on election night as President-elect Donald Trump secured victory.
According to the report, Attorney General Merrick Garland and senior DOJ officials were “stunned,” with some reportedly weeping, reflecting a broader sense of disarray within the department.
The revelations sparked a strong response from former Trump administration officials, including Steve Bannon and Mike Davis, who criticized what they see as the politicization and weaponization of the justice system during a segment on Bannon’s War Room.

They emphasized the need for accountability among those within the DOJ, suggesting that legal preparations among officials were justified.
Discussing the NBC report, Bannon pointed out the irony of DOJ officials panicking over potential legal repercussions. “NBC News reports this morning that Merrick Garland was stunned on election night and that senior Justice Department officials were weeping,” Bannon said.
“That’s up on the stack, if you go to Citizens Free Press right now in Kane. What does that tell you, Davis, that they’re all worried about going bankrupt lawyering up—like none of us had to pay millions of dollars of legal fees? Or some people, like Rudy, are actually going into bankruptcy because of it.”
Bannon framed the situation as a reflection of the DOJ’s recent actions, suggesting that officials are now facing the same scrutiny they imposed on others.
Mike Davis, founder of the Article III Project and a vocal critic of the DOJ, argued that the panic within the department is justified given its history of alleged political targeting. “They should be panicked. They should be fearful. They should be crying because they have politicized and weaponized our justice systems at every level,” Davis said.
He pointed to several examples, including the FBI’s Crossfire Hurricane investigation, which targeted Trump’s 2016 campaign, and what he described as the persecution of Trump associates like Peter Navarro and Bannon himself.
Davis also cited the Biden-Harris administration’s actions against parents opposing “gender chaos” in schools and pro-life Christians targeted under the FACE Act.
“They sent pro-life Christians, including a 75-year-old Christian, to prison under the FACE Act because of this corrupt civil rights division by the Biden-Harris Justice Department,” Davis said, adding that DOJ Civil Rights Division head Kristen Clarke “perjured herself to get the job.”
Davis echoed the DOJ’s own mantra in calling for accountability. “There has to be accountability for what happens. So I’m glad that they’re fearful. I’m glad that they’re crying. They should lawyer up because nobody is above the law, as they always told us,” Davis stated.
He added, “If they didn’t commit a crime, they have no reason to be fearful, they have no reason to be crying, right? Because, of course, you don’t prosecute for non-crimes, do you?”
