A Kenyan-born former state official with a felony sexual assault conviction quietly rose through the ranks to become a division director within the Minnesota Department of Education, according to documents and reporting from Alpha News and Blaze News.

Wilson Nduri Tindi, 42, who entered the U.S. on a B-2 visitor visa in 2005 and overstayed his legal stay, pleaded guilty in 2015 to felony fourth-degree criminal sexual conduct after an incident in which he broke into a woman’s Minneapolis apartment and assaulted another woman who was sleeping there.

Court records show he touched the victim’s genitals and buttocks over her underwear before attempting to remove it. A fingerprint at the scene matched Tindi, who denied being in the apartment.

He was sentenced to two years, with the sentence stayed for five years, and served 210 days at Hennepin County Adult Corrections Facility. He was also required to register as a predatory offender.

Prosecutors introduced allegations of a similar 2012 assault as evidence of a behavioral pattern, although no charges were filed in that case.

In that case, court documents say a woman awoke to find Tindi allegedly on top of her, penetrating her with his finger and mouth, and when she begged him to stop, he allegedly replied:

“You like this.”

Despite this history, Tindi was hired by the State of Minnesota in 2018 as a principal auditor.

He later served as chief audit officer at the Minnesota Pollution Control Agency and, most recently, as director of Internal Audit and Advisory Services at the Minnesota Department of Education (MDE). He held that title as of December 2023.

According to an archived version of his online bio, Tindi oversaw internal auditing functions related to risk management and compliance and claimed to be “passionate about building trust through transparency.”

His bio has since been removed from MDE’s website, and the agency confirmed in an automatic email reply that “Wilson Tindi is no longer with MDE.”

Tindi’s criminal record also includes a June 2025 arrest for allegedly driving under the influence and refusing a field sobriety test. He posted $12,000 bail and was released on June 10.

Tindi’s immigration history includes a 2007 denial of his permanent residency application, a 2009 removal order, and a 2011 reversal of that order. He became a lawful permanent resident in April 2014 — six months before the sexual assault.

Following his conviction, another removal order was issued in 2017, but he challenged it in federal court. In 2018, U.S. District Judge David Doty granted Tindi’s habeas petition, ruling that the government had not proven he was a flight risk or a danger, despite the conviction.

It remains unclear whether the Minnesota Department of Education or the Pollution Control Agency were aware of Tindi’s background.

Requests for comment from both agencies, as well as Governor Tim Walz’s office, have not been answered. Tindi’s name no longer appears on MDE’s public staff directory.
