A 30-year-old illegal alien originally from Colombia appeared in a New York courtroom on Thursday following his arrest earlier this year for the alleged rape of a 14-year-old boy in an East Harlem park.
The defendant, Nicol Suarez, is accused of following the teenage boy into a bathroom at Thomas Jefferson Park with the intent to sexually assault him.

According to law enforcement, the boy escaped the bathroom and alerted nearby officers, leading to Suarez’s arrest.
The charges against Suarez include first-degree rape and stalking, both felonies under New York state law.

Suarez appeared in court on Thursday, where Judge Michele Rodney scheduled a pre-trial hearing for mid-September.
During the appearance, an interpreter was present to assist Suarez, who is not fluent in English.
Suarez’s defense attorney asked the court for more time to file motions, but the judge denied the request.
The court session lasted under 10 minutes, after which Suarez was returned to custody at Rikers Island, the city’s main jail complex.
Authorities also discovered at the time of Suarez’s arrest that there were active warrants for the defendant in both Massachusetts and New Jersey.
In addition, federal immigration authorities issued a detainer request after Suarez was taken into custody in February.
Initially, prosecutors sought bail in the amount of $500,000 and a bond of $1.5 million.
Those amounts were later reduced by Judge Elizabeth Shamahs.
Suarez remains in custody.
The charge of first-degree rape in New York carries a maximum sentence of 25 years in prison.
The felony stalking charge carries a potential maximum sentence of seven years. Suarez has not entered a plea.
The Manhattan District Attorney’s Office has not commented further on the case.
Immigration and Customs Enforcement (ICE) has also not confirmed whether additional immigration proceedings will follow the criminal trial.
The case remains ongoing.
Suarez is scheduled to return to court in September for the pre-trial hearing.
