President Donald Trump’s White House has waived the protections of nine aides to former President Joe Biden ahead of their Congressional hearings on the former president’s fitness while he was in office, a senior White House official confirmed to the Daily Caller.
The decision to waive the executive privilege of the Biden aides will allow Congress to press the former staffers on their private conversations with the former president, unless they or Biden try to challenge the move in court, Axios first reported. The other aides exempt from executive privilege include former adviser to first lady Jill Biden, Anthony Bernal, as well as former advisors to Joe Biden: Annie Tomasini, Ashley Williams, Mike Donilon, Anita Dunn, Ron Klain, Bruce Reed and Steve Ricchetti, according to Axios.

“Evidence that aides to former President Biden concealed information regarding his fitness to exercise the powers of the President — and may have unconstitutionally exercised those powers themselves to aid in their concealment — implicates both Congress’ constitutional and legislative powers,” Trump’s deputy White House counsel, Gary Lawkowski, wrote in a letter published by Axios.
The GOP has launched four separate investigations into Biden’s decline while in office. Most notably, Kevin O’Connor, the former White House physician to President Biden, is set to sit for a deposition before the House Oversight Committee in July, the Daily Caller previously reported.
O’Connor initially declined to comply with the panel’s request for voluntary testimony, according to a subpoena issued by Chairman and Republican Kentucky Rep. James Comer. Earlier in June, four Biden administration aides voluntarily agreed to sit for transcribed interviews with the House Oversight Committee.

The former president’s decline has recently come back into the spotlight after CNN Host Jake Tapper and Axios reporter Alex Thompson published a book detailing just how bad the 82-year-old’s condition was behind closed doors. The book was based on nearly 200 interviews with Biden White House staffers and Democratic insiders.
One excerpt from Thompson and Tapper’s book alleged that aides were considering putting Biden in a wheelchair post-election, and another alleged that Biden didn’t recognize his longtime friend George Clooney at a big fundraiser.
