You Will Not Believe How Australian Court Punished a Woman for Saying a Man Is a Man

Kirralie Smith is an activist who is desperately trying to keep men out of women’s sports. 

Obviously, to make her argument, she needs to say that the people with penises who are invading women’s sports are, in fact, men. 

If she were forced to start with the premise that the men in question are women, the argument makes no sense, right? It would sound like she is arguing that women should be kept out of women’s sports.

But in Australia, it is illegal to call a man pretending to be a woman a “man.” 

An Australian women’s rights advocate has been ordered to pay a combined total of $95,000 AUD to two trans-identified men, with an additional $40,000 penalty in the case of non-compliance. Kirralie Smith was found guilty by a New South Wales court of “unlawfully vilifying” two trans-identified males who made headlines for participating in women’s sports.

Justin “Riley” Dennis and Nicholas “Stephanie” Blanch lodged criminal complaints against Smith for raising public awareness of their inclusion in women’s football. Smith, a spokeswoman with Binary Australia, a campaign group dedicated to advocating for single-sex sports in Australia, had been raising public awareness of their inclusion in women’s sports after learning of injuries sustained by female players.

The judgement was decided by Magistrate Sharon Freund on August 26, who stated: “I am satisfied that the defendant unlawfully vilified the Plaintiff … when she referred to the plaintiff as a male or a man.”

Smith has been ordered to pay significant sums to the two men as compensation for the “misgendering” within 28 days.

You see the point of these laws and punishments, right? It is to make dissent from “approved” opinions illegal. No doubt thousands of people have thrown slurs at Jones for being a “transphobe” or a “bigot,” and they will face no charges for “unlawful vilification.” 

What does that even mean?

It is disappointing that the word ‘woman’ has been redefined to include males and that the words ‘violence’ & ‘vilification’ have been applied to speaking the truth about information in the public domain.

Australians should be very concerned about their freedoms.

Women have effectively been erased from law and attempts to advocate regarding public policy are shut down for the sake of the feelings of a few. 

Males should never be permitted to participate in female sport. As a registered third-party political campaigner and a woman, I should have the right to advocate for this without being penalized.

This decision, along with the High Court Appeal for the apprehension of violence order being denied, sets a precedent that all journalists, politicians and political advocates must take note of.

The law might state men can be women, but it defies the laws of nature and cannot be sustained.

 Nothing will steal my joy in knowing that I am a woman and no male ever will be. I am proud to stand for truth and reality.

The point of such laws is to capture the language, and distort everybody’s ability to think things through. 

So what exactly was Jones being punished for? Saying this:

“Men of mid coast NSW [New South Wales], can you get in touch with me please? I need your help. There is a bloke playing on the women’s team in Wingham and many are upset about it. The federation is refusing to listen,” Smith posted to X on January 19, 2023.

“Wingham Football Club on the Mid North Coast of NSW published these photos on their Facebook page in December 2022. The bloke in a frock was receiving an award for playing in the women’s division,” Smith’s article read.

“The bloke in a frock can play either in the men’s competition or a mixed competition, there is absolutely no need for him to play in a women’s division,” Smith added. “No one is saying he can’t play. It is simply a matter of fairness, safety, and dignity. He is male and does not belong in a female division. Women and girls deserve to have the option of a female-only competition.”

It would be impossible to make her case if she could not say that the players were male. But saying that is now illegal. 

As troubling as the attack on free speech is across the West, it is particularly troubling that the Anglosphere is leading the charge. The whole concept of free speech as a right was solidified after long battles in the Anglosphere. The French and the Germans have always been lukewarm to free speech, but the “rights of Englishment” that developed during the Enlightenment helped open the world to greater freedom. 

Now that is gone. Australia, New Zealand, and Great Britain have fallen. 

Biden tried to do that to the United States by supporting European efforts to regulate what we can say on the Internet. In fact, the European Union has just fined X for violating its Digital Services Act. 

It’s no surprise the first company the EU Commission has fined under the DSA is @X.

Comply, or else. That is the message to citizens. 

It is totalitarian at its core. Control the narrative, control the people.
