New York City Mayor Zohran Mamdani is facing mounting criticism over housing policy decisions as landlords and property owners point to long-standing state and city laws they say already heavily favor tenants and limit basic property rights, as reported by Fox News.

The latest controversy centers on Mamdani’s decision to appoint Cara Weaver, a housing activist and critic of private property ownership, to lead the city’s Office to Protect Tenants.

Weaver has previously described homeownership as a form of “White supremacy” and has advocated for government seizure of private property, statements that have drawn scrutiny from property owners and national officials.

The White House has criticized the appointment, and the Department of Justice under President Donald Trump has signaled interest in monitoring whether any city policies infringe on constitutional property rights.

Federal officials have not announced formal action but have indicated concerns about proposals that could go beyond existing tenant protections.

The debate comes as New York City continues to operate under one of the most restrictive landlord-tenant frameworks in the country.

According to landlord advocates, current laws already impose extensive limits on rent collection, eviction, and rent increases.

“New York has the most tenant protections of any state,” said Ann Korchak of the Small Property Owners of New York.

Under existing rules, tenants facing eviction are guaranteed city-funded legal representation, a process that can stretch eviction cases well beyond a year.

Even after a court orders a tenant to vacate, state law allows tenants to request up to an additional year to remain in the unit if they claim they cannot find comparable housing in the same neighborhood.

City programs also allow tenants to receive emergency rental assistance, known as “one-shot deals,” that cover back rent while allowing tenants to remain in place.

Property owners argue that the system often results in prolonged periods without rent payment.

Rent increases are also tightly controlled. Approximately 960,000 apartments in New York City are rent-stabilized, meaning allowable rent increases are set by the city’s Rent Guidelines Board.

During the administration of former Mayor Bill de Blasio, the board approved zero percent increases for three consecutive years.

Mamdani campaigned on a similar rent freeze proposal and is expected to appoint a majority of Rent Guidelines Board members due to current vacancies, positioning the administration to influence future rent decisions.

State law further limits rent increases tied to major capital improvements.

The 2019 Housing Stability and Tenant Protection Act capped increases related to qualifying building upgrades at 2 percent, even when owners undertake significant repairs required to meet housing codes.

Property owners say these restrictions have contributed to widespread disinvestment. State data indicate that at least 26,000 apartments are currently vacant, with owners citing financial infeasibility of repairs under existing rent limits.

Even apartments not covered by rent stabilization face restrictions under the state’s “good cause eviction” law, which ties rent increases to the Consumer Price Index and requires lease renewals.

The law applies to units renting for amounts well above median income thresholds.

Mamdani himself previously lived in a rent-stabilized apartment in Astoria while serving in the New York State Assembly, where legislators earn a base salary of $142,000 annually.

Critics argue that tenants in regulated units often retain long-term occupancy rights that extend beyond ownership, including the ability to transfer rent-stabilized apartments to family members.

City officials have defended tenant protections as necessary for housing stability, while property owners warn the cumulative effect has reduced available housing and discouraged new investment.

The administration has not announced changes to existing statutes but continues to emphasize tenant enforcement efforts through the Office to Protect Tenants.
