CCRKBA Celebrates SCOTUS’ Decision to Hear Hawaii Carry Ban Case

CCRKBA Celebrates SCOTUS’ Decision to Hear Hawaii Carry Ban Case

The state of Hawaii may have all the natural beauty and wonderful weather you could ever want, but there’s no way in hell I’d live there. Not only does the Jones Act make everything way too expensive there, among other factors, but the gun control laws there are absolutely bonkers.





But, slowly, piece by piece, some of those laws are being torn apart.

Not because the good lawmakers of Hawaii have decided that no, gun control isn’t acceptable, and those laws should be repealed. That would be great, but it’s not happening. 

Instead, it’s via court challenges, and a case challenging the state’s carry restrictions is going to the Supreme Court, for which the Citizens Committee for the Right to Keep and Bear Arms is thrilled.

Via a press release:

The Citizens Committee for the Right to Keep and Bear Arms is delighted by the Supreme Court’s decision to hear a case that could expand carry rights on private property open to the public, such as shopping malls, restaurants and stores. The case is known as Wolford v. Lopez.

“The time has come for such questions to be decided,” said CCRKBA Chairman Alan Gottlieb. “There are tens of millions of legally-armed private citizens who almost daily find themselves barred from entering business establishments, office buildings, movie theaters, restaurants and even supermarkets, simply because they are exercising their Second Amendment rights.”

He said laws which are deliberately designed to put a stranglehold on the right to bear arms are simply unconscionable, especially in the aftermath of the Supreme Court’s 2022 Bruen decision. 

“We cannot continue living in an environment where restrictive laws essentially create a situation where we have half of a right,” Gottlieb observed. “The Second Amendment guarantees a right to bear arms, and laws specifically designed to restrict that right amount to an infringement the Court cannot allow to stand. A right which exists only on paper is no right at all.

“Everyday, somewhere in this country, a private citizen suddenly finds himself or herself in the middle of an emergency,” he observed. “In those instances, where their lives or the lives of other persons hang in the balance, their right to self-preservation hinge upon whether they can exercise their right to keep and bear arms. That’s really what this case is all about, and we are eager to see how the high court will decide this thorny issue.”

The Supreme Court convenes on Monday for the 2025-26 session. 





Hawaii’s prohibition essentially makes concealed carry impossible for most people who are trying to live their lives. Most businesses they’re likely to visit will be open to the public because they’re part of the public. Just about anywhere they want to go is open to the public.

Because of the nature of the state’s prohibition, it doesn’t matter.

Instead, businesses have to expressly opt-in to allow concealed carry, which many aren’t likely to bother doing one way or another, thus creating a default situation where it’s assumed your rights don’t exist unless someone grants them. This is not a right, but a privilege, and it’s also not how we view literally any other right.

We don’t prohibit saying grace in restaurants unless the owners permit it. Doing so would be an outrage and would quickly be overturned by the courts.

We don’t assume that people have no right to voice their opinions in buildings open to the public. We simply empower businesses to ask those people to leave if they don’t like what they’re saying.

But guns are different in the eyes of Hawaiian lawmakers. Guns are a different thing because the Second Amendment is a second-class right, in their minds. It’s contrary to the “Aloha Spirit” or some other such nonsense, and therefore, they can do whatever they want by making every business default to a gun-free zone.





I’m glad the Supreme Court has agreed to hear this case. Hopefully, they’ll put an end to this crap once and for all.
