Defense Distributed Was Never Going Down Without a Fight

On Tuesday, the Second Amendment Foundation and Defense Distributed won a key court case in the Fifth Circuit. This ruled that the ATF’s frame and receiver rule was unconstitutional. Cam covered the story then.





This was a continuation, essentially, of the VanDerStock case, but after the case was remanded, Defense Distributed and the SAF were pretty much the last people standing.

And, as we know, it paid off for them.

The thing is, though, Defense Distributed was never going down without a fight.

While the frame and receiver rule basically broke down into “it looks enough like a gun, so we’re calling it a gun,” Defense Distributed’s Cody Wilson had other plans.

I had the chance to talk to him last year about them, and it seems like a hell of a time to bring them back out for one and all. Watch and enjoy.

This is a fascinating little piece of technology that is essentially a receiver, but not a receiver. It doesn’t look like one at all. You could probably carry it in your pocket through TSA, and while you might get questioned, no one would think you had a gun on you. And if you haven’t done anything to it, it’s not one, so you’re not breaking the law in the first place — but don’t take this as legal advice, because I’m not a lawyer, nor did I stay at a Holiday Inn Express last night.

This particular case deals with more “traditional” frames and receivers, which is absolutely vital because, frankly, the entire thing with frames and receivers was that it had no historical basis. However, when the Supreme Court ruled on VanDerStock, they remanded it back to the lower court. That would be the Fifth Circuit, and this is where we’re at, and Judge O’Connor’s decision was fantastic.





But Defense Distributed did something fantastic here, too. It’s different than the traditional “ghost guns,” a term Cody likes an awful lot and thinks we should embrace simply because it’s pretty dope, but that doesn’t matter.

See, the ultimate thing that every anti-gunner needs to know is that there’s a streak that runs through the firearm industry where there’s no need to bother with playing nice with its critics because it’s not like environmentalists blasting Big Oil. They might dislike the industry, but they’re also still customers, so Big Oil has a reason to play nice.

Anti-gunners, though, aren’t really customers. Even if they buy a gun, they don’t want anyone else to be able to have one, which means appeasement is pointless.

Wilson seems to get this on a visceral level, and the result is that he, along with many others, watch as anti-gunners pat themselves on the back for putting an end to something, and they simply think, “Challenge accepted, Mofo.”

To say that speaks to my soul is putting it mildly, to say the least.

He’s far from alone on that, to be sure, and that’s why it works.
