CCRKBA Applauds Virginia Prosecutors Who Vowed Not to Enforce Unconstitutional Gun Ban

CCRKBA Applauds Virginia Prosecutors Who Vowed Not to Enforce Unconstitutional Gun Ban

I still sit here shaking my head over Virginia. I’ve talked a bit about how it seems like their politics swings back and forth with the wind, but last year’s off-year election was particularly strange. Suddenly, the leadership in the state is bad enough that some are probably looking back on Ralph Northam with fond memories.





Despite campaigning on affordability, the new Democratic leadership decided instead to focus on guns and gun control, passing a slew of measures, including an assault weapon ban.

The powers that be in Richmond are very upset that some prosecutors have said they won’t enforce these unconstitutional gun laws. Do you want to know who isn’t upset in the least? Among others, the Citizens Committee for the Right to Keep and Bear Arms.

From a press release:

The Citizens Committee for the Right to Keep and Bear Arms is applauding the decision by at least four county prosecutors in Virginia to not enforce the ban on so-called “assault firearms” and original capacity magazines, signed into law by Democrat Gov. Abigail Spanberger.

Prosecutors in Powhatan, Pulaski, Smyth and Spotsylvania counties say the ban violates the Second Amendment. Those Commonwealth attorneys are Phillip Blevins Jr. (Smyth County), Rob Cerullo (Powhatan County), Justin L. Griffin (Pulaski County), and Ryan Mehaffey (Spotsylvania County). The Washington Times is reporting that Scott County Commonwealth’s Attorney Kyle Kilgore “made similar remarks.”

“We are proud of these men for taking a stand against legislation which is clearly unconstitutional,” said CCRKBA Chairman Alan Gottlieb. “Abigail Spanberger ran for office as a moderate, but immediately after being sworn in, her far-left agenda became apparent, and she especially launched an attack on the Second Amendment rights of law-abiding Virginians.  

“When the new law takes effect July 1, ironically just three days ahead of the nation’s 250th anniversary, we are confident it will be successfully challenged in court,” he added. “The four prosecutors have reportedly reviewed the new statute, and they have all concluded that the ban is unconstitutional, and therefore unenforceable. We certainly agree.

“Nowadays,” Gottlieb observed, “it has become obvious that such bans are not being pushed by Democrats in the interest of public safety, but in a concerted effort to crush the protections guaranteed by the Second Amendment. Whether the issue is a gun ban in Virginia, or a permit-to-purchase requirement, or a ‘sensitive places’ carry prohibition, all of these measures are infringements on the rights of honest citizens, while having absolutely no impact on criminals, and politicians like Spanberger know it. 

“That’s why we’re delighted that these county prosecutors have taken a stand for common sense and the Constitution, and we encourage more prosecutors to join them,” he concluded.

What’s truly hilarious about the outrage among the state’s executive branch is that, as Cam noted on Tuesday, this same party passed a law a few years back that says judges must grant a prosecutor’s motion to dismiss. This came after several district attorneys announced they weren’t going to prosecute low-level marijuana arrests. The state Supreme Court said they couldn’t do it, so Democrats in Richmond passed the law to counter that.

Now, that same law is going to be used to justify prosecutors in different counties refusing to enforce an unconstitutional gun ban, among other things.

There’s poetry in that, let me tell ya. Absolute poetry.

It’s especially hilarious when you consider how illegal alien sanctuaries are, essentially, the same kind of thing. They’re selective enforcement of the law because the powers that be disagree with the law in question.

Democrats have pushed these policies for years, and now prosecutors in Virginia are simply applying the hoist to the petard and pulling. 

Obviously, I agree with the CCRKBA on this entirely. This is nothing more than an attack on the Second Amendment that not just runs counter to the text of the amendment, but every Supreme Court ruling on the subject of the Second Amendment this century.
