The Biden Justice Department has turned its spotlight on one of George Soros’s most controversial political beneficiaries, Fairfax County Commonwealth’s Attorney Steve Descano, as reported by RedState.
The long-criticized prosecutor is now under federal investigation for allegedly offering sweetheart deals to violent illegal immigrants while going soft on public safety for everyday Virginians.
It’s been quite a week for Democrats in Virginia. While FBI agents raided the offices of state Senator Louise Lucas in a major corruption probe involving cannabis dispensaries, the DOJ decided to look into Descano’s sentencing practices in Northern Virginia.
According to the department’s announcement, the Civil Rights Division will examine whether Descano’s office discriminated against U.S. citizens by granting preferential treatment to illegal immigrants charged with serious crimes.

Assistant Attorney General Harmeet Dhillon minced no words in laying out the stakes of the investigation.
This is not ok!
I have reason to believe other woke DAs are doing this, and we will investigate and take legal action if justified! https://t.co/NYWABaQFlK— AAGHarmeetDhillon (@AAGDhillon) May 6, 2026
“Under my leadership, the Civil Rights Division will not allow local prosecutors to pick and choose winners based on their immigration status,” she said.
“This investigation will uncover whether this prosecutor is putting the community at risk in offering sweetheart deals to illegal immigrants charged with serious crimes.”
NEW from DOJ: the Justice Department notified the Fairfax County, Virginia Commonwealth’s Attorney Steve Descano of the initiation of a federal investigation into the Commonwealth’s Attorney Plea Bargaining, Charging Decisions, and Sentencing Policy.

That statement resonated deeply in Fairfax County, where residents have long complained that Descano’s “reform” brand of prosecution has looked more like deliberate neglect.

Prosecutorial discretion is one thing, but Descano’s pattern of dropping charges, issuing lenient plea bargains, and ignoring repeat offenders has crossed a line for many local families.
The Department of Justice’s probe will dig into how the Fairfax County prosecutor’s office handles plea bargaining, charging decisions, and sentencing recommendations.
The focus is on whether Descano’s policies are discriminatory under Title VI of the Civil Rights Act of 1964, the Safe Streets Act, and the law enforcement misconduct statute 34 U.S.C. § 12601.
For years, critics have pointed out Descano’s dangerous double standard. He touts “holistic” approaches to criminal justice, but the results have often left victims shattered and communities terrified.
One of the most heartbreaking examples involved the brutal murder of Virginia mother Stephanie Minter, slain at a Fairfax County bus stop.
The alleged killer, an illegal immigrant from Sierra Leone, should never have been walking free. Descano had apparently allowed him to skate more than 30 times on offenses ranging from theft to sexual assault.
That tragedy sparked outrage, and rightly so. It epitomized the chaos that comes when ideology overtakes responsibility.
While average Virginians pay the price in fear and funerals, Descano and his progressive allies pat themselves on the back for “equity-driven” law enforcement.
Now, it appears that Washington has finally decided to take a closer look at the mess he’s left behind.
The DOJ’s move came on the heels of months of media scrutiny.
Conservative outlets have exposed Descano’s botched prosecutions and released case after case showing illegal immigrants escaping serious punishment.
Many in the community suspect a politically motivated shield around offenders who fit the left’s narrative of victimhood.
The Fairfax attorney’s office, as expected, is playing it cool. But the federal inquiry suggests this situation is anything but routine.
The pattern of unequal treatment in Fairfax County has been too blatant for too long, and local families have been demanding accountability that never came at the ballot box.
In responding to a tweet about the federal action, Harmeet Dhillon underscored the scope of the issue: “This is not ok! I have reason to believe other woke DAs are doing this, and we will investigate and take legal action if justified!”
That warning should make progressive prosecutors across the country nervous. Their ideological approach to justice has already left communities in chaos from San Francisco to Chicago, and federal scrutiny could be a sign their political protection is wearing thin.
Descano, who rode the Soros-funded “criminal justice reform” wave into office, now finds himself the poster child for its failures.
While he claimed to be revamping a broken system, Fairfax County residents got skyrocketing crime and a prosecutor who seemed more interested in defending criminals than protecting citizens.
This investigation could redefine the battle lines over public safety in Virginia. With federal agents digging into his record, Descano’s political future looks dim.
More importantly, it sends a signal to every Soros-backed DA that the era of unchecked ideological prosecution may finally be facing a reckoning.
Ordinary Americans have had enough of officials who treat law-abiding citizens like second-class residents while bending over backwards for dangerous illegal offenders.
It’s about time someone in Washington noticed. And now, thanks to this DOJ probe, Fairfax County might start seeing justice not just as a concept but as an action once again.
