The mayor of Naples, Florida, is back in custody after authorities say she violated the terms of her probation tied to a prior drunk-driving case, as reported by The New York Post.

Teresa Heitmann, 62, was arrested Monday night after allegedly testing positive for cannabinoids during a court-ordered drug test conducted on March 26, according to police records obtained by Gulf Coast News and WINK. The arrest comes less than two years after her initial DUI case, which led to her current probation status.

Heitmann has been charged with unlawful possession or use of cannabinoids. The test result is said to violate the conditions of her probation stemming from her August 28, 2024, arrest for driving under the influence.

City officials acknowledged the situation in a statement following her arrest.

“We are aware of the situation involving Mayor Teresa Heitmann,” a Naples spokesperson said. “The Naples residents and visitors can be assured that the City Council, administration, and staff remain dedicated to serving our community.”

The statement added that the city’s vice mayor will assume responsibilities during Heitmann’s absence.

Heitmann did not immediately respond to requests for comment following the arrest.

The mayor has served in her position since 2020. Her legal issues began with a DUI arrest in August 2024, when she was found to have a blood-alcohol level more than twice the legal limit after crashing into a neighbor’s mailbox. Body camera footage from the incident showed Heitmann attempting field sobriety tests and identifying herself to officers.

At one point during the interaction, she is heard saying, “No, don’t call me mayor.” She added, “I am Teresa Heitmann right now. I am not the mayor.”

In February, Heitmann pleaded no contest to DUI with a blood-alcohol level of 0.15 or higher. As part of the sentence, she was placed on probation for one year. The probation conditions reportedly included restrictions on alcohol use, mandatory substance abuse evaluations, and random drug testing.

Authorities say the March 26 drug test was part of those conditions. The reported positive result led to the probation violation charge and her subsequent arrest.

Heitmann is currently being held at the Naples Jail, according to WINK. She was scheduled to appear in court on Tuesday afternoon to address the alleged violation.

The case marks a continuation of legal troubles for the mayor, who remains in office while proceedings move forward. City officials have not indicated whether further administrative or legal actions will be taken regarding her position.
