Republican lawmakers are intensifying scrutiny of birth tourism, warning that organized schemes can turn American citizenship into a commodity while exposing taxpayers and national security to serious risks.

The practice involves foreign nationals traveling to the United States to give birth so their children receive citizenship.

House Oversight Committee Chairman James Comer said the industry goes far beyond clever manipulation of immigration rules.

“The birth tourism industry engages in fraud and other criminal activity, threatens our national security, and costs U.S. taxpayers,” Comer told the Daily Caller News Foundation.

Comer said testimony before his committee revealed how operators and foreign nationals allegedly exploit American institutions.

“Another witness detailed how foreign nationals engaged in birth tourism exploit our immigration laws and drain taxpayer-funded resources,” Comer continued.

“The Oversight Committee, alongside the Trump administration, will continue to fight these illegal practices, hold those responsible accountable, and restore integrity to our immigration system.”

That promise signals congressional investigators are not treating the matter as another harmless immigration loophole.

The Oversight Committee announced in May that it was investigating several companies accused of participating in birth tourism.

Its Task Force on Defending Constitutional Rights and Exposing Institutional Abuses later held a Sept. 1 hearing examining “the prevalence of birth tourism schemes” nationwide.

Republican Texas Rep. Brandon Gill framed citizenship as a privilege that hostile foreign interests have learned to exploit.

“Being a citizen of the United States of America represents full legal membership in the great American experiment,” Gill said during the hearing.

“But the concept of birthright citizenship is being exploited by foreign nationals, including those from adversarial nations like the People’s Republic of China and Russia.”

That concern carries obvious weight when citizenship can provide lifelong access to American territory, institutions, elections, and public benefits.

The Migration Policy Institute estimates that between 22,000 and 26,000 babies are born through birth tourism in the United States each year.

Government figures, however, showed roughly 9,600 births to mothers with foreign addresses as of 2024.

A Center for Immigration Studies fact sheet identified participants from China, Taiwan, Korea, Nigeria, Turkey, Russia, Brazil, and Mexico.

The organization also reported that some travelers conceal the real purpose of their visits to avoid additional scrutiny from immigration officials.

Federation for American Immigration Reform deputy general counsel Chris Hajec warned that the national security consequences could emerge years after a child receives citizenship.

“Birth tourism could result in people raised in foreign countries opposed to America being able to enter America at will, spy on this country and vote in our elections,” Hajec said.

Hajec predicted stronger enforcement could reduce the practice.

“Birth tourism is likely to decline, because, following the Supreme Court’s decision [on birthright citizenship], greater efforts will be made to prevent it, such as enforcing a policy of not issuing tourist visas to pregnant women, or banning birth tourism hospitals,” he added.

The Supreme Court ruled June 30 that President Donald Trump’s order seeking to deny automatic citizenship to certain United States born children violated the Constitution’s Citizenship Clause.

Trump later issued an Aug. 6 order targeting birth tourism operators and the visa categories they allegedly abuse.

That order stated that “the immigration laws of the United States establish discrete categories of temporary nonimmigrant visas to allow foreign visitors into the United States for study, exchange, temporary employment, tourism, and other transitory activities that are now exploited by birth tourism operators.”

The State Department announced an August task force that will review “the activities of visa holders worldwide to identify instances of birth tourism, take action to revoke visas of those who engage in or facilitate it, and dismantle the networks that profit from this abuse.”

Authorities have already uncovered evidence of sophisticated operations.

A United States embassy in West Africa found a “sophisticated” network involving more than 100 foreign nationals who allegedly used fabricated documents to obtain visas and secure American citizenship for their children.

Texas Gov. Greg Abbott directed state agencies in July to investigate suspected schemes and “hold every provider that facilitates them accountable.”

Republican Tennessee Rep. Andy Ogles also introduced legislation in June aimed at stopping birth tourism across the country.

Ogles offered a blunt warning about the larger threat. “Foreigners have embedded themselves into our society and are being trained by foreign governments to corrupt our culture.”

For Republican lawmakers, the debate is about sovereignty, accountability, and whether American citizenship remains meaningful.

Their message is simple: citizenship should not become a prize sold through deception while taxpayers are handed the bill and hostile governments gain another opening.
