Maybe somewhere near the beginning would be good. Like the note from the National Archives and Records Administration (NARA) that Jack Smith used to start the criminal investigation of President Trump’s handling of classified information.
Or, at least, what Smith says was a ‘criminal referral’ from NARA to begin crawling up the ex-president’s classified wazoo.
Turns out, that isn’t what it was at all.

New documents first obtained by the Daily Caller suggest former special counsel Jack Smith may have misled lawmakers and the public regarding the pretext for his investigation into President Donald Trump’s retention of classified documents.
The documents reveal the National Archives’ internal watchdog did not consider its February 2022 message to the Justice Department (DOJ) about Trump’s possession of classified documents a criminal referral, contradicting Smith’s account of how the case began. The National Archives and Records Administration (NARA) Office of Inspector General (OIG) case report from February 2022, obtained by Senate Judiciary Committee Chairman Chuck Grassley, notes that its message to the Justice Department was a referral, but not a criminal referral.
Not a ‘criminal’ referral?
Actually, no, when you read it. It sounds like more of a ‘Clean up on Aisle 7‘ request.
…“The OIG determined that this matter and the other relevant matters be classified as -R (referral to DOJ for their assessment and guidance, not the same as a criminal referral for prosecution which is only done for criminal investigations),” the report first made in 2022 and edited throughout 2023 to include such information notes.
FBI messages included in the documents show that the bureau first treated the missing documents complaint as a “spillage” issue with “little likelihood of being pursued as a criminal matter.”
That’s bad enough, but according to what the Daily Caller has seen of the documents, the White House staff was surrounded and under surveillance by bureaucratic snakes in the grass of the first and worst magnitude.
…In June 2023, Smith’s office received a massive trove from NARA: 54 spreadsheets of text messages from inside Trump’s orbit obtained from the White House custodian.
After obtaining the documents, senior attorney Thomas Windom was eavesdropping on the conversations between Trump and his top advisors in his first administration, including former Chief of Staff Mark Meadows, former Director of National Intelligence John Ratcliffe, former Deputy Chief of Staff Dan Scavino, first daughter Ivanka Trump, Vice President Mike Pence, and many others. It appears the review was done without first separating potentially privileged information.
It’s only getting worse for the despicable Mr. Smith, who went to Washington today to testify in front of a Senate Judiciary Committee hearing.
The first thing they learned officially was that Mr. Smith is very nosy and could give a rip about anyone’s constitutional rights.
Smith started hoovering up cell phone and other personal records of conservative media outlets that cover the government and the folks who work for them without any discernment.

Committee chairman Senator Chuck Grassley was apoplectic with impotent rage.
Former special counsel Jack Smith’s investigators obtained records containing communications between nearly 50 journalists and Trump administration officials — including Fox News personnel — after subpoenaing text-message records associated with dozens of White House phones during the federal election investigation of President Donald Trump, Fox News Digital has learned ahead of Tuesday’s Senate Judiciary Committee hearing.
Previous congressional disclosures showed investigators obtained records involving members of Congress. The latest records reveal the production also included communications between government officials and journalists working for some of the country’s largest news organizations.
The communications appeared in records produced by the National Archives in response to a subpoena seeking material associated with 87 White House phones from Trump’s first administration, according to a spokesperson for Senate Judiciary Committee Chairman Chuck Grassley, R-Iowa, citing whistleblower disclosures made to the chairman.
“What will the partisan media say about this disgraceful government overreach? This wasn’t a normal prosecution by any means,” Grassley challenged in comments to Fox News Digital on Tuesday, as critics have highlighted the lack of concern or coverage given to Smith’s probe by legacy media.

The latest facts about Jack Smith’s illegal jihad were released by Sen. Charles Grassley during a Senate Judiciary Committee oversight hearing on Tuesday.
The Federalist’s team of investigative reporters exposed the Russian collusion hoax. We exposed the Kavanaugh hoax. We exposed the Ukraine impeachment hoax. And The Federalist’s Editor-in-Chief Mollie Hemingway wrote the definitive account of how Democrats seized control of election infrastructure and destroyed the integrity of American elections in 2020.
For over a decade, The Federalist has fearlessly exposed Deep State corruption and DOJ lies and lawfare. Spying on us was apparently part of Jack Smith’s plot to get revenge against us.
The First Amendment is the bedrock of the American Constitution. A free press is integral to the American republic and our entire way of life. And Jack Smith fed the whole thing through a shredder in his insane and illegal attempt to rig the 2024 elections through lawfare, intimidation, and unconstitutional attacks on free speech and the First Amendment.
As shocking as this news may be to some, I am not surprised to learn of this behavior by Jack Smith and the Biden administration. At the direction of the Biden administration, the federal government illegally censored The Federalist, tried to bankrupt us, and was eventually forced to admit it had zero legal authority to do any of it.
We took these thugs to court and won when we learned of their illegal censorship efforts, and we will explore all legal options going forward to deal with Jack Smith’s lawless and un-American attempts to silence us by spying on us.
Nobody in corporate media said a word in our defense when we were illegally censored. Outlets like CNN and the New York Times, which posture as First Amendment purists, had nothing to say about the Biden administration’s illegal attempts to punish us for our rigorous and accurate journalism.
I have zero doubt that they will be similarly silent today, because they are partisan hacks who supported Jack Smith’s egregious lawfare every step of the way.
Unlike corrupt corporate media, The Federalist will always fearlessly and accurately report the news, even in the face of never-ending Democrat assaults on the First Amendment, free speech, and freedom of the press.
We will never back down, and we will never stop reporting the facts and defending the greatest nation and greatest people on earth. Hillary Clinton couldn’t stop us, Joe Biden couldn’t stop us, and Jack Smith’s corrupt thuggery won’t stop us.
