Judge Orders New Rollout of Mamdani’s Pied-A-Terre Tax

Last month I wrote about the botched rollout of Mayor Mamdani’s pied-à-terre tax. The city published a searchable list of properties that could be subject to the tax.

Mayor Zohran Mamdani opened a new front in his ongoing battle with New York City’s wealthy after his administration published a searchable database identifying affluent property owners who could be subject to the city’s proposed pied-à-terre tax, a move critics say could expose them to harassment and public safety risks.

The database, released by the city’s Department of Finance, allows users to search properties and view the names and addresses of owners whose non-primary residences could be subject to the proposed tax.

One of the people who appeared on this list was Scott Galloway, the left-leaning podcaster who hosts a show with Kara Swisher. Galloway argued that he’d been “doxed” by the city and seemed shocked that a socialist mayor would suggest rich people had done something wrong.

Galloway: He’s implying we’ve done something wrong because we’re successful?…New York is the New York is the the last place you want to demonize success. The reason people move to New York is they think, “I want to be successful on Broadway. I want to be successful in business. I want to be successful in the arts. And no one’s going to get in my f***ing way if I’m really talented and work hard. We’re going to celebrate it. We’re not going to we’re not going to put a big R on your door and say you’ve done something wrong because you’re successful.”

To break it down, the city posted a list of 900,000 people, implying they’d all done something wrong, but only sent letters to 17,000 of them claiming they were subject to the tax. That’s less than 2 percent. Put another way, 98 percent of the people on the list got doxed for no reason other than Mamdani’s desire to demonize them.

Alex Berenson, whose mother somehow wound up on the list, said it this way.

Of course, Mamdani’s pied-à-terre tax isn’t just about pied-à-terres, or even the billionaires who own them. It’s about stoking resentment toward an ever-expanding list of class enemies. As it turns out, “tax the rich” has no fixed definition of rich, and the line only moves in one direction.

This was all about being an in-your-face socialist goon for the cameras. The demonization was the point. 

Tuesday, a judge ruled that the tax rollout was such a mess the city would need to start over.

New York City Mayor Mamdani must redo the rollout of his new pied-à-terre tax, a state judge ruled Tuesday, dealing a major blow to one of the mayor’s signature policies.

Justice Wayne Ozzi, of Staten Island, sided with plaintiffs who said the rollout of the surcharge unlawfully put the burden on homeowners to prove their residency status, when city officials should have verified that information themselves…

“City Hall botched this rollout and should have just admitted error and fixed its own mistake, instead of wasting time and taxpayer dollars by fighting it in court,” said Randy Mastro, a lawyer for the plaintiffs.

Ozzi’s ruling blocks the city from taking any further action on the notices that have already been sent to about 17,000 New Yorkers, and forces the administration to take down the tax roll of about 900,000 properties that it published online as part of the rollout.

The city plans to appeal the ruling and used the opportunity of the loss to, what else, demonize the rich some more.

Within hours of the decision, the city filed court papers saying it would appeal — a move that would place the ruling on hold until an appellate court weighs in. Matthew Rauschenbach, a spokesman for Mr. Mamdani, said the city would meanwhile “continue implementing the surcharge fairly, efficiently and in full compliance with the law,” he said.

“Our administration is fighting every day to deliver for working New Yorkers,” Mr. Rauschenbach said. “The ultrawealthy are fighting in court to avoid paying their fair share. They have filed lawsuit after lawsuit to protect their privilege, and we will not back down.”

What happens next will depend on how the appeals court decides the case. The best case for Mamdani is that it overturns Judge Ozzi’s decision and the tax can continue as planned. But if it rules in Judge Ozzi’s favor, the city will be facing a big mess.

…if Justice Ozzi’s order is upheld, the city faces the difficult proposition of starting from scratch to send out tax bills before the end of the year, said Mark Limardo, a partner at the law firm Herrick Feinstein who works on tax matters.

“This is a big chunk of work that the city will have to engage in,” he said. “It remains to be seen if the city has the resources right now to even do it, and to do it quickly.”

Judge Ozzi’s ruling, even if it’s upheld, doesn’t threaten the tax itself. However, there are two more lawsuits in the pipeline that challenge the legality of the tax.

Both of those suits argue that the tax itself is unconstitutional and should be overturned. They say that the law establishing the tax violates provisions of the state constitution that limit how much the city can collect in real estate taxes every year. Among other claims, they also argue that the tax is discriminatory because it applies only to residents of states other than New York.

The first suit, filed on Monday, was brought by the former commerce secretary Wilbur Ross, his wife Hilary Geary Ross and the casino mogul Steve Wynn, all of whom live in Florida but own second homes in New York City. Notices from the city indicate that the Rosses would owe roughly $83,000 and Mr. Wynn about $183,000 under the tax, according to the lawsuit.

The second lawsuit, filed on Tuesday, was brought by the corporation that owns an Upper East Side co-op building known as The Montclair, and by a handful of homeowners, including some who live in Florida and in Suffolk County.

So we’ll have to wait and see how this all plays out, but right now it’s an embarrassment for the Mamdani administration which made a mess of this rollout.
