Just last month I wrote about an incident like this in Scotland. A trans woman who was being kept in a women’s prison there was charged with sexually assaulting fellow inmates. Also last month, a woman serving time at a prison in Windham, Maine filed a lawsuit alleging she was sexually harassed by a trans inmate named Andrea Balcer.
Katie Mountain is serving a 10-month sentence for violating probation at the women’s prison in Windham. In a lawsuit, she said she is bunking with Andrea Balcer, a transgender resident at the prison.
In that lawsuit filed on Thursday, Mountain alleged that Balcer has subjected her to graphic sexual stories, trapped her in the bathroom, forcibly kissed her and made repeated threats of rape and impregnation.
The lawsuit also alleges that Balcer told Mountain, “Don’t worry, if you don’t wake up, it’s because I smothered you with a pillow.”
In some cases, threats like that might be dismissed as just talk, but in this instance Katie Mountain can’t afford to do that because Balcer is serving a lengthy sentence for murdering his parents.
A Winthrop 20-year-old who fatally stabbed her parents and pet dog in 2016 has been sentenced to 40 years in prison.
The judge handed down the decision Tuesday in Augusta, after Andrea Balcer pleaded guilty to the crimes in September. That plea agreement capped the maximum sentence at 55 years.
Balcer is transgender and went by Andrew at the time of the crime. Balcer was 17 years-old at the time of the crime, but was charged as an adult in this case…
“I snapped,” Balcer could be heard saying to police over the phone, explaining what led to the murders. In the call, Balcer goes on to describes picking up a knife, waking up her mother, Alice, then stabbing her in the back when she came to Balcer’s bedroom to comfort Balcer.
Balcer was calm and explanatory as she then detailed how her father, Tony, woke up to the sound of the attack and came to Balcer’s bedroom. “I stabbed the **** out of him,” Balcer says coldly in the 9-1-1 call.
He then killed the family dog because it was barking. Balcer apparently claimed during the trial that his parents had objected to his trans identity, but an uncle testified during the trial that wasn’t true.
“I want to immediately dispel the idea that these murders had anything to do with gender identity,” Pierce explained. He, and many others, told the court that Alice and Tony would never have been abusive toward Andrea, nor would they have challenged Andrea’s gender transition, as she claimed after her arrest.
Balcer got 40 years and under Maine law wound up serving it in a women’s prison where, according to Katie Mountain, he has been sexually harassing and making threats.
Yesterday, three more female inmates at the same prison joined Mountain’s lawsuit, claiming they too have experienced Balcer’s harassment.
In the updated suit, inmate Jennifer Albert alleges Balcer “subjected her to unwanted sexual contact,” including one incident that involved digital penetration while Albert was suffering from a back injury.
Inmate Michaela Sargent, using masculine pronouns, claims Balcer “routinely harassed her with graphic threats of rape and exposed himself to her.”
Danielle Foster, in the suit, charges that Balcer stood naked in her room while she slept and suggested doing “things” to her in her sleep. Foster also said she was forced to witness other transgender female inmates exposing themselves.
“All four women allege that when they reported these incidents or refused to affirm Balcer’s gender identity, they were met with retaliation,” Dill wrote in a press release. “This included being placed in segregation, being denied hygiene supplies and medication and losing eligibility for early release while Balcer allegedly continued to enjoy the ‘full panoply of perks’ in the women’s prison.”
The revised lawsuit challenges a 2021 gender ID law which said trans women must be jailed according to their chosen gender, not their biological sex.
According to the complaint, since Maine’s Gender ID law was amended in 2021, forcing prisons to accept the stated gender of inmates, the number of reported sexual misconduct incidents at Maine prisons has almost quadrupled.
