NY Gun Control Failures on Full Display As Teen Charged With Pistol Whipping, Sexual Assault

New York’s restrictive gun laws are supposed to make it incredibly difficult, if not impossible, for prohibited persons to get ahold of a gun, but in reality it’s the law-abiding who are really impacted. 

Take this disturbing case out of New York City, where a 14-year-old is facing charges after allegedly pistol-whipping and sexually assaulting a woman who was making deliveries in an inside a New York City Housing Authority complex earlier this month. 

The 37-year-old woman was hit in the face with a black and silver gun and sexually assaulted inside the Berry Houses near Dongan Hills Avenue and Jefferson Street at around 6 p.m. on September 9, police said. 

A woman in the building said the victim delivered a package and then went upstairs, but never came down.

“I heard a thumping sound, thought she was jumping down the steps, but that was probably him dragging her,” a building resident told PIX11 News.

Police arrested a 14-year-old in connection with the brutal attack; a 14-year-old who’s barred from possessing a firearm by federal, state, and local laws. 

None of those prohibitions stopped the teen from illegally arming himself, nor did any of New York’s restrictions hinder his ability to get ahold of a gun. The Empire State requires background checks on all transfers of firearms, and even on the purchase of ammunition, but those laws apparently had no effect whatsoever. 

The teen is also far too young to obtain a New York City carry permit, and while the delivery woman might have been able to get a permit of her own, it would take months on end and hundreds of dollars to do so. And depending on where her deliveries take her, she could be barred from carrying at some of those locations under New York’s “sensitive places” law, which would make it extraordinarily difficult for her to carry anywhere when she’s on the clock. 

That, in a nutshell, is the problem with New York’s approach to gun ownership. The folks who are willing to follow the law are forced to jump through all kinds of hoops, while those who couldn’t care less about the law aren’t exactly losing sleep over whether they’re illegally carrying a firearm.

We don’t know yet how this 14-year-old allegedly got his hands on a gun. Maybe it was stolen. Maybe he got it from a friend or relative. Maybe he bought it on the street. That’s something investigators will hopefully be able to determine.

What we do know is that there was no way for him to legally acquire or possess that firearm, but he had one anyway.

Meanwhile, if the woman he’s accused of attacking wanted to carry a gun for protection while she was making deliveries, she’d have to spend hundreds of dollars, undergo hours of mandated training, submit fingerprints and references, and wait months for the NYPD to give her permission to exercise a constitutionally protected right. Even then, she’d have to keep track of New York’s lengthy list of places where her permit doesn’t allow her to carry.

Would this attack have happened if she was carrying a handgun for her protection? There’s no way to know, and I’m not going to pretend otherwise.

I do know, though, that New York’s gun laws didn’t stop this 14-year-old from allegedly getting his hands on a firearm, even while they made it incredibly difficult for his victim to carry one of her own.
