Illegal Alien Captain in NY Harbor Disaster That Killed Mother, Daughter, Finally Taken Off Streets [WATCH]

A deadly boating disaster in New York Harbor has taken an immigration turn after federal officials revealed that the unlicensed captain accused of capsizing an overloaded charter vessel was in the country illegally.

The Aug. 8 wreck killed 27-year-old Sara Sanchez and her five-month-old daughter, Antonella Garcia, as reported by The New York Post.

The captain who helmed a motorboat that capsized in the waters off lower Manhattan near Liberty Island — killing a young mom and her 5-month-old daughter — was arraigned in Manhattan Federal Court today.

Manuel Hernandez, 46, a limousine driver from El Salvador, allegedly operated the 21-foot boat despite having no boating license and no formal training for the job.

Federal authorities say he was also unlawfully present in the United States when the vessel overturned near Liberty Island.

The Department of Homeland Security said Wednesday that Hernandez is now being held by federal immigration authorities.

The case combines illegal immigration, an unauthorized charter operation, and allegations of reckless conduct that ended with a mother and her infant losing their lives.

Homeland Security Secretary Markwayne Mullin said Hernandez was illegally conducting unlicensed tours when the boat capsized.

Mullin described him as a criminal illegal alien whose alleged recklessness brought horrifying consequences for a family expecting a birthday celebration, not a fight for survival.

“Thanks to the hard work of the men and women of the Coast Guard, ICE, and our federal, state, and local partners, this criminal is off our streets and out of our waterways,” Mullin said.

“Once he faces justice for his crimes, we will make sure that he is swiftly removed from our country.”

Hernandez was arrested and charged in federal court with two counts of misconduct and neglect of a ship officer resulting in death.

He was initially released after posting $50,000 bail, but immigration authorities later stepped in following a Coast Guard investigation.

The United States Coast Guard Investigative Service determined that Hernandez was an illegal migrant, according to federal officials.

Immigration and Customs Enforcement then took him into custody, where he is being held without bail while the criminal case proceeds.

Federal authorities say Hernandez illegally crossed the southern border through Texas in 2007.

He allegedly lied to a border agent and falsely claimed to be an American citizen, adding another serious allegation to a record now under intense scrutiny.

Prosecutors say Hernandez packed 14 passengers aboard the charter boat for a birthday party cruise near Liberty Island.

Specifications for a vessel that size generally call for no more than 10 people, meaning the boat allegedly carried four passengers beyond its typical capacity.

Investigators also found that the vessel lacked a life jacket designed for a child or infant.

Hernandez allegedly told passengers that life jackets were not required, a claim that now looks especially reckless given the age of the youngest passenger and the dangerous conditions on the water.

Authorities say Hernandez turned and accelerated after striking a swell during the cruise.

That maneuver allegedly caused the overloaded vessel to capsize, throwing everyone aboard into the harbor and turning a festive outing into a frantic rescue operation.

Passengers were pulled from the water by another charter boat, along with crews from the New York Police Department, the New York Fire Department, and the Coast Guard. Despite those efforts, Sanchez and her baby daughter could not be saved.

Authorities said Hernandez had been hired as a limousine driver by the tour operator, yet he periodically captained illegal harbor cruises anyway.

He allegedly did so without the licensing, preparation, or training expected of someone entrusted with passenger safety on one of the busiest waterways in the country.

“Illegal charter operations gamble with human life, and in this case the alleged conduct led to an unthinkable tragedy,” Coast Guard investigator Josh Packer said in a statement.

That grim assessment cuts through the excuses and gets straight to the point.

The criminal prosecution will determine Hernandez’s legal responsibility for the deaths, while immigration officials are preparing for removal proceedings after the case is resolved.

For now, federal custody means the accused captain is no longer free to operate another unauthorized cruise or disappear while two grieving families wait for justice.
