Rep. Chip Roy accused Special Counsel Jack Smith of abusing his authority and operating outside his lawful powers during an exchange with Fox News host Harris Faulkner, saying the conduct warrants deeper scrutiny in an upcoming congressional hearing.

Roy said Smith improperly ran his operations through Washington, D.C., relied on subpoenas issued through various channels, and continued acting as a special prosecutor even after a federal judge ruled aspects of his appointment improper.

“He was abusing his authority. He was using DC to do his dirty work, and running all of his operations through here to get subpoenas and do the work, through bows, Berg and through barrel Howe,” Roy said. “And then he magically moves down to South Florida to go down there.”

Roy referenced a federal court ruling that halted Smith’s operation and said Smith nevertheless continued functioning in the role.

“Then he gets his entire operation slapped down by a federal judge last summer. But he continue, or in 2024 and that he continues to operate and sign materials as a special prosecutor, even though he was deemed inappropriate,” Roy said.

“So this guy’s been abusing authority, and we need to expose it.”

Faulkner pressed Roy on the potential legal implications of Smith’s actions, asking directly about the consequences of signing official documents without proper authority.

“What kind of crime is that if you sign federal papers and you’re already pulled from that position?” Faulkner asked.

Roy said the question is central to what lawmakers plan to examine in detail, stressing that Smith must account for how he continued operating after losing the authority to do so.

“Well, this is all of the stuff that we need to get into further tomorrow,” Roy said.

“We need to look into this and understand and he needs to go on the record about how he was continuing to operate, even though he didn’t have the power to do it.”

Roy characterized Smith’s conduct as politically motivated rather than a legitimate law enforcement effort, saying the matter will be addressed publicly at the hearing.

“And this was a rogue prosecutor engaged in political activity,” Roy said.

“I think that Chairman Jordan will make this very clear at the outset of the hearing tomorrow.”

Roy added that Smith is likely to attempt to justify his actions but said the facts point to a different conclusion.

“And look, he’s going to try to hide behind smoke and mirrors to say he was doing, you know, good work that he was trying to but the fact is, this was a political exercise,” Roy said.
