Supreme Court Shuts Down Virginia Democrats’ Gerrymander Power Grab [WATCH]

The Supreme Court of the United States handed Virginia Democrats a harsh reality check by refusing to swoop in and rescue their attempted gerrymander scheme.

After the Virginia Supreme Court ruled against a blatantly partisan redraw of the state’s congressional map, Democrats begged for federal intervention.

In a unanimous order with zero dissents, the nation’s highest court simply said no.

The failed appeal marks a significant setback for Democrats who were hoping to use the courts to override a constitutional process that had already been ruled invalid within their own state.

Here’s What They’re Not Telling You About Your Retirement

The Virginia Supreme Court determined that the so-called redistricting referendum, which had been advanced by the state’s Democratic majority, violated the plain text of the Virginia Constitution.

Virginia Governor Abigail Spanberger, a Democrat, did not take the news well.

She vented on social media, declaring that both the state and federal Supreme Courts had “chosen to nullify an election.”

Spanberger went even further, accusing the courts of silencing the voices of over three million Virginians who voted in favor of the measure.

Her response seemed aimed more at rallying the Democratic base than addressing the legal merits of the case.

“The Supreme Court of the United States has now joined the Supreme Court of Virginia in choosing to nullify an election and the votes of more than three million Virginians,” Spanberger wrote.

“These Virginians made their voices heard, casting their ballots in good faith to push back against a President who said he’s ‘entitled’ to more seats in Congress before voters go to the polls.”

This is so absurd. The U.S. Supreme Court has no role here and never did. Democrats made this appeal to do exactly what Spanberger just did with this irrelevant point. They’re blaming SCOTUS instead of themselves for breaking the law and ignoring the Virginia constitution. https://t.co/2EEUUKSd9V

Of course, what Spanberger did not mention is that her party’s measure was built on shaky legal ground from the start.

Virginia Democrats, led by Attorney General Jay Jones and Solicitor General Tillman Breckenridge, had rushed to file an emergency application earlier in the week, claiming that the state Supreme Court had misread both state and federal election law.

Their filing accused the Virginia Supreme Court of misunderstanding two “critical issues of federal law.”

First, they insisted the state’s high court misinterpreted election day requirements under federal law, and second, that it wrongfully seized power from the state legislature to set rules for federal elections.

In other words, Democrats argued that the Virginia Supreme Court had no right to intervene in what they saw as a legislative activity.

But the Virginia Supreme Court saw things differently and made that clear in its 4-3 ruling.

The justices found that the entire “legislative process” behind the proposed redistricting amendment had ignored a crucial requirement in Article XII, Section 1 of the Virginia Constitution.

According to that section, the General Assembly must vote twice on any proposed constitutional amendment at two separate legislative sessions, separated by an intervening House of Delegates election.

The court concluded that Democrats had failed to follow this process and therefore acted in violation of the state’s Constitution.

WATCH:

It was a straightforward application of state law, not the sweeping disenfranchisement storyline that Democrats tried to spin afterward.

Had the referendum survived, Democrats would have gained an overwhelming political advantage in future elections.

Projections showed that their proposed redistricting map would have flipped Virginia’s current 6-5 Democrat-to-Republican split into a lopsided 10-1 majority favoring Democrats.

That lopsided result is exactly what constitutional checks and balances are supposed to prevent.

The U.S. Supreme Court’s silence spoke volumes.

With no justices dissenting, it was clear that not even the liberal members were willing to hang their reputations on what amounted to an attempt to politicize the judicial process.

The ruling also reinforces the principle that states must respect their own constitutional procedures instead of trying to rewrite them on the fly for political gain.

Spanberger’s fiery rhetoric about “nullifying an election” might sound dramatic, but it misrepresents the real issue.

No votes were nullified.

What was stopped was an unconstitutional process engineered to expand Democratic power. The court decisions affirmed the rule of law, not a partisan agenda.

The rejection from SCOTUS highlights the growing frustration among Democrats who increasingly turn to the courts when their political strategies fail.

From redistricting fights to election procedures, Democrat officials have made a habit of seeking judicial intervention when the democratic process does not yield outcomes they desire.

This time, neither the state nor the federal justices were willing to indulge that maneuver.

For Virginia voters, this outcome restores confidence that election laws cannot be rewritten at will by those in power.

It also sends a strong signal that the nation’s highest court will not act as a political referee every time one side loses at home.

Instead, the Court’s message was clear: follow your own constitution, respect your legislative processes, and stop expecting the judiciary to do your campaigning for you.

The end result is a win for fairness, restraint, and constitutional order, even if that means Democrats must accept that their political ambitions cannot override the law.

Once again, the courts chose the Constitution over political convenience, and that is something every Virginian should welcome.
