Awkward: DC Circuit Tells Trump Not to Knock Down East Wing of the White House

These are silly, silly people who do not have enough to do to keep them busy.

The majority said Congress, not the President, controls major changes to the White House. It found no law authorizing the administration to demolish the East Wing and replace it with a privately funded ballroom, making the project likely unlawful unless Congress approves it.

All this because the National Trust for Historic Preservation thought the new ballroom too Trumpian gauche.

…The National Trust for Historic Preservation, a private group, had sued to stop the ballroom. The trust said its members had standing to sue because if the project were completed, it would upset the “aesthetic” of the complex, with the ballroom dwarfing the main White House building.

Since when is WAAH! an actionabl…oh, forget it.

And quite a few legitimate questions over security at the White House if work at the hole-in-the-ground construction site is suddenly forced to a screeching halt. Particularly considering the security upgrades that were going into the new structure replacing the ugly 1940s-era office building that had been this remarkably mourned and lamented late East Wing.

The D.C. Court has given the president 14 days to appeal to SCOTUS, and the injunction halts all the construction.

It would not shock me at all to see SCOTUS enter a summary order granting relief to the Administration in the ridiculous ballroom case, and remand the matter to the D.C. Circuit for further consideration, citing favorably Judge Rao’s dissent, Sec. II(A) — a lack of standing by…

The dissent that Ship references in his Xweet is pretty blistering. Judge Rao flat-out says that the National Trust has no standing to bring a lawsuit in the first place, thanks to mere ‘aesthetic displeasure,’ and that, since the project is completely funded by private donations, what business is it of Congress anyway?

…Judge Neomi Rao, a Trump appointee who dissented from Friday’s ruling, called that a weak justification for the lawsuit. She said she would have ruled the trust lacked legal standing.

She also gave significant weight to the government officials who had said halting construction now would be a security issue. She said that should have outweighed the “aesthetic harm” 

“The district court elevated the aesthetic displeasure of a single passerby over the government’s security interests in the ballroom and the security risks of leaving an open construction site at the president’s home and office,” she wrote.

Judge Rao also said presidents have long enjoyed freedom to make improvements to the White House residence.

She said the ballroom seems to fall under that category since it will be directly tied to the residence through the White House’s East Room.

And she found that the ballroom could be funded with private donations, alleviating Mr. Trump of the need to go to Congress for financial approval.

As for SCOTUS, didn’t they just settle some Supremacy Clause questions? A president rearranging the furniture and a wall or two would seem to fall under that. It certainly held true for previous presidents’ renovation projects, many of which were quite extensive.

There’s also a question about some of the verbiage in the majority decision for the injunction. Specifically, where the judges ‘found no law authorizing the administration to demolish the East Wing and replace it with a privately funded ballroom.’ Aren’t laws written to restrict something or someone rather than authorize it? Why would there be a specific law on ‘demolishing the East Wing,’ etc. They obviously did NOT find the law that said Trump could not do it, so they had to kind of wing that part.

This is sad commentary on the judiciary again.

Now, Trump, for all the ‘Dictator!’ screaming and ‘FASCIST!‘ histrionics that the Left indulges in, has yet to ignore a single injunction or court order, which is also why we can’t have nice things right away. He’s following the legal process and always has when he gets checked.

But there are level-headed people so frustrated by these activist courts with their sorry excuses for rulings and romance novel-level judgments who believe this just might be the one that breaks the Donald’s back.

Trump just posted he’s going to the mattresses again.

President Donald Trump said he would appeal to the Supreme Court after a federal appeals court ruled he lacks the legal authority to build his sprawling White House ballroom without congressional approval.

A split three-judge panel for the US Court of Appeals for the District of Columbia Circuit earlier Friday ordered construction to stop on the 90,000-square-foot ballroom, but stayed its decision for two weeks to allow the administration time to appeal.

“We will be immediately appealing to the United States Supreme Court,” Trump posted Friday on social media, calling the order “horrendous, politically motivated, and unlawful.”

The decision marked a blow for Trump, who has focused intensely on his construction projects in Washington, of which his planned ballroom is the centerpiece. He has devoted copious time to speaking about the efforts, despite grappling with a months-long conflict in the Middle East and a shaky economy at home.

Such ridiculous crap.
