Democrat Rep. LaMonica McIver announced Tuesday that she is pregnant while facing up to 17 years in prison on three federal counts, as reported by The Gateway Pundit.

The New Jersey Democrat disclosed the pregnancy amid a prosecution tied to a confrontation with federal law enforcement officers in Newark.

The announcement pairs deeply personal news with a serious criminal case that has already involved a federal grand jury, a federal judge, and an appeals court.

McIver, 40, said she intentionally chose to become pregnant despite the possibility of spending nearly two decades behind bars.

In June 2025, a federal grand jury returned a three-count indictment against McIver.

The indictment charged her with forcibly impeding and interfering with federal law enforcement officers at the Delaney Hall detention center in Newark.

McIver addressed the stark timing of her decision directly, acknowledging that some people might consider it unusual.

She also framed the pregnancy as a personal decision that she would not allow the administration to consume.

“People might find it crazy that even though I’m facing 17 years in prison, I made the decision to get pregnant. But, at the end of the day, this is something I couldn’t let be consumed by this administration,” Rep. McIver said.

McIver followed that statement with another declaration about how she views her circumstances. “I refuse to let them take my joy or my future,” she said.

The criminal case stems from events at a Newark detention facility in May 2025.

According to the source, McIver verbally abused and physically assaulted federal agents during the confrontation at the facility.

The footage became a central piece of the public account surrounding the charged encounter.

McIver also delivered a profane declaration during the confrontation. “I touch whoever I want, motherf*cker!” McIver shouted.

The prosecution did not disappear after the initial charges were brought. Last year, a federal judge declined to throw out the federal charges against the New Jersey Democrat, allowing the case against her to continue.

McIver later pursued an immunity argument connected to her position in Congress.

Last month, however, a federal appeals court rejected that defense following the confrontation with ICE agents at the Newark detention center.

The Third Circuit Court of Appeals considered McIver’s claim that she could not be prosecuted because of the Constitution’s “speech or debate” clause.

The appeals court rejected that argument, leaving the federal case in place.

The ruling marked another legal setback for McIver as she continued confronting the three counts.

She now faces the prosecution while publicly discussing both her pregnancy and the potential 17-year prison sentence attached to all three counts.

Her announcement did not change the charges described in the federal indictment.

Those counts still accuse her of forcibly impeding and interfering with federal law enforcement officers during the Delaney Hall confrontation.

The congresswoman’s own comments placed the pregnancy decision squarely alongside the criminal case.

Rather than avoiding the extraordinary contrast, McIver acknowledged that people might find her choice “crazy” while she faces the possibility of 17 years in prison.

At the same time, McIver presented the decision as an assertion of control over her personal future.

Her statements emphasized joy and the future, even as the courts have rejected both an effort to dismiss the charges and her subsequent immunity defense.

The case therefore remains active following the decisions described by the source.
